Session Overview
El Salvador has become the jurisdiction of choice for launching digital asset projects in Latin America. Its Digital Assets Issuance Law regulates the full life cycle of a token offering, its tax regime is favourable without offshore stigma, and its regulator, CNAD, reviews and approves each issuance before it reaches the market. Global projects are increasingly launched from El Salvador precisely because it offers what most jurisdictions cannot: a purpose-built framework rather than one retrofitted from securities law written for a different era.
But a launch jurisdiction is a starting point, not a finished plan. A digital asset can be created in one country, marketed in another and held somewhere else entirely — and the moment the investors, customers, marketing or service providers sit inside the European Union, a second regulatory system applies. The technology travels; the regulation does not.

Michał Wołoszański, Founder and Managing Partner at AGA member firm Wołoszański & Partners in Warsaw, heads the firm’s blockchain and crypto-asset practice and advises international clients on MiCA and EU financial services regulation. A co-author of the Poland chapter of the Chambers Blockchain & Crypto-Assets 2026 Global Practice Guide, he will then take the same project into the EU, using Poland as a practical lens to examine the implications of MiCA for projects structured outside the EU. |
Using the recurring case study model, Daniel and Michał will close with a practical cross-border roadmap: define the product, classify the activities, map the jurisdictions, identify the regulatory path, and build for expansion.
