Guatemala Introduces New Anti-Money Laundering Regulations
16 October 2026
Guatemala’s new anti-money laundering regulations bring changes to shareholder registers and registration requirements. Enrique Búcaro of Paloma Abogados, AGA’s law firm representative in Guatemala City, explains what businesses need to know.
Guatemala has introduced new anti-money laundering regulations. The law took effect on September 17, and although the implementing regulations are still pending, certain specific requirements are already in force regarding updates to shareholder registers and mandatory registrations for what the law refers to as Obligated Persons.
The new Anti-Money Laundering and Other Assets Law updates the legal framework in line with international standards. It strengthens measures against money laundering and illicit asset-related crimes and establishes a modern administrative compliance and oversight regime.
The law designates as “Obligated Persons” individuals and legal entities engaged in more than thirty covered activities. Businesses and individuals should determine whether the rules apply to them and seek appropriate legal guidance, as affected entities must adapt once the implementing regulations take effect, which is expected within three to six months.
Organizations should assess whether they qualify as an Obligated Person and register with the IVE when required. They should also identify money-laundering and illicit-asset risks and adopt mitigating measures, including a compliance manual, customer due diligence, transaction monitoring, and procedures for detecting and reporting suspicious activity.
Additional obligations include appointing and training a Compliance Officer, meeting corporate transparency requirements, and updating shareholder information through certified filings with the Mercantile Registry when applicable. Effective compliance will depend on legal understanding, proactive risk management, and sound corporate governance, making timely preparation essential.
